Rent Payment Regulations in North Dakota
North Dakota has no rent control statutes and prohibits counties or local governments from enacting rent control. State laws also stipulate that late fees must be reasonable and clearly stated in the agreement at the beginning of the lease term. While there are no set grace periods, it is common practice for landlords to provide a three-day notice to pay or quit.
North Dakota Security Deposit Rules
In North Dakota, the legal limit for security deposit payments is one month’s rent, with exceptions for renters who have a criminal record or a history of violating their lease. Any deposit collected by the landlord must be held in an interest-bearing account for the tenant’s benefit. The earned interest must be paid to the tenant if the deposit is held for more than nine months.
At the end of the lease term, landlords have 30 days after the lease end date to return the deposit to the tenant. Funds from the deposit may be deducted to cover the costs of unpaid rent, necessary cleaning, or damages beyond normal wear and tear. The landlord must provide a statement of deductions when returning the deposit.
Landlord Entry and Repairs in North Dakota
When the landlord needs to enter the rental property, they must provide the tenant with a reasonable written or verbal notice, except in an emergency situation. Additionally, they are responsible for maintaining units’ habitability by ensuring adherence to basic health and safety standards and promptly addressing necessary repairs. If the landlord fails to make repairs, the tenant has the right to arrange their own remedies and deduct the costs from their rent.
